 @  anil,

For  what  stuff  do  you  want  to  file  a  patent?  Is  it  a  device  (mechanical,  electrical,  electronics,  etc.....).  Based  on  which  there  are  different  procedures...

Is  it  related  to  Aquarium  hobby?

Please  give  sufficient  details  so  that  people  can  guide  you  correctly...

i  dont  thing  you  can  claim  copyrights  to  a  hybrid.....i  might  be  wrong.  never  heard  of  someone  one  claiming  patent  or  copyrights  to  a  fish.  Basically  what  you  are  lookin  for  is  permission  to  breed  and  sell  your  fish  (which  is  a  hybrid  i  am  assuming?)  or  monetary  contribution  from  revenue  generated....either  way  this  is  a  grey  area  if  you  ask  me

u  cant  have  a  patent  on  a  hybrid  fish  ,its  just  a  variation  of  the  original  thats  it,  u  can  have  a  fish  named  after  u  if  discover  a  new  species  might  be  or  i  might  be  wrong  also,

but  iam  sure  many  people  have  developed  lot  of  hybrids  in  birds  ,  carps,  cichlids, dogs,  cats, cows  nothing  is  named  after  a  single  person  and  it  cannot  get  patented,  other  wise  doberman  ,pug  ,  greatdanes,  bulldogs  who  made  them?,

and  aslo  hybrids  are  interbred  to  form  new  hybrids,  then  if  given  a  patent  a  single  person  could  claim  that  his  hybrid  cannot  be  used  in  futher  hybridization  ,  so  which  is  not  possible  ,so  it  cant  be  given  a  patent   .

If  there  is  genetic  modification,  the  process  of  genetic  modification  can  be  patented.  If  its  just  from  cross  breeding,  I  dont  think  thats  possible.

As  far  as  I  know,  glofish  are  patented  (atleast  the  process  of  genetic  modification  is).

Don't  know  the  process,  but  when  Plant  hybrids  are  patented,  fish  hybrids  too  can  be.

Patenting  of  life  forms  is  a  highly  controversial  subject.
Each  country  has  come  up  its  own  rules.
It  would  be  better  for  you  to  consult  an  patent  attorney.
