 Hi  Friends,  
    today  I  am  writing  this  thread  in  a  complete  Frustrated  state.  I  am  looking  for  your  help  to  know  how  to  get  in  touch  with  the  Consumer  Forum  and  take  legal  steps  against  a  fraud.  
 
 I  have  ordered  a  bottle  of  Excel  from  a  well-known  Indian  Online  Store  on  29th  July,  2008.  Till  date  I  didn't  get  the  product  delivered  to  me  even  after  12  days.  Now  let  me  tell  you  the  drama  behind  this  transaction,
 
 1.  I  ordered  for  Excel  29th  July  and  waited  for  6  days.
 
 2.  I  called  up  the  owner  asking  the  status  of  the  order  and  got  to  know  that  will  be  shipped  day  after  as  he  was  out  of  station.
 
 3.  Till  yesterday  when  I  didn't  receive  the  order  delivered,  again  I  called  up  the  owner.  He  told  that  product  is  shipped  already.  So  I  asked  for  the  tracking  number  so  I  can  track  the  courier  by  my  own.  The  owner  told  me  to  call  him  today  Morning.
 
 4.  Today  morning  I  again  called  up  the  owner  from  my  mobile  and  he  didn't  pick  it  up.  S  I  again  called  up  from  a  landline(The  number  was  unknown  to  him)  and  he  picked  it.  When  I  asked  for  the  courier  tracking  number,  he  told  me  to  call  me  back  again  after  1  hr.
 
 5.  I  lost  my  patient  and  directly  asked  him  if  he  is  fooling  me  around.  And  surprisingly  I  got  to  know,  that  the  product  is  not  shipped  yet.
 
 6.  He  asked  me  if  I  am  buying  something  from  him  for  the  first  time  or  not.  When  I  have  told  him   I  have  already  made  couple  of  transaction  previously  with  him  and  faced  the  same  problem,  he  told  he  will  try  to  deposit  the  money  back  to  me  and  hung  up  the  call  without  uttering  a  word.
 
 
 Now  my  concern  is,  here  we  are  many  hobbyists  who  are  dealing  with  that  guy  or  planning  to  do  it.  If  it  is  started  to  continue,  that  means  that  dealer  is  fooling  around  and  using  our  money  to  gain  the  interest  on  it.  And  this  is  becoming  an  unnecessary  harassment  to  the  customers.
 
 As  far  as  I  know,  in  US  and  Europe  they  have  strict  rules  for  these  king  of  frauds.  So  here  in  India,  if  I  want  to  take  any  legal  step  against  that  dealer,  what  the  steps  should  I  follow.
 
 P.S:  Sorry  to  bring  up  this  matter  in  open  forum.  But  I  think  it's  important  to  let  fellow  hobbyists  know  about  the  incident  so  they  can  watch  there  steps  in  future.

 Most  irritating  thing  for  a  crazy  hobbyist  Smile
 
 Regarding  taking  legal  course,  Im  not  sure  how  things  are  done  for  online  orders,  but  you  will  always  have  bank/cc  statements  to  prove  when  the  payment  was  made.  In  my  opinion,  12  days  might  be  quite  short  for  the  court  to  consider  it  as  a  delay,  its  sad  but  I  think  thats  what  is  the  thing.  Maybe  you  will  have  to  send  couple  of  formal  letters  to  the  seller  and  if  you  dont  get  any  proper  solution,  you  can  take  the  legal  course.
 
 As  ours  is  a  quite  close  knit  community,  I  think  disclosing  the  name  of  the  seller  might  be  a  better  course  as  it  will  directly  affect  the  seller's  business  (ofcourse,  if  the  Admins  are  ok  with  it)  and  he/she  will  be  more  careful  (if  any  one  buys  from  them).

 In  US/UK,  the  customer's  credit/debit  card  is  finally  charged  only  after  the  item  is  shipped.  This  practice  is  followed  by  many  reputable  sellers.  They  might  put  a  hold  on  your  card  at  the  time  of  ordering,  though.
 
 If  we  want  to  continue  dealing  with  this  person/website,  we  could  together  demand  that  he  also  follows  the  same  process.  I  am  sure  merchants  could  place  hold  (and  not  charge)  on  cards  in  India  too.

 If  youi  have  purchased  it  via  cc  dont  do  anything,  just  call  up  the  CC  people  and  ask  them  to  help  you  out.  
 
 Before  that,  also  see  the  websites  disclaimer  and  find  out  whats  on  it.  
 
 Taking  legal  action  is  not  a  problem  Mumbai  has  a  cyber  crime  cell  with  the  police,  it  will  not  be  a  problem  at  all.
 
 do  not  disclose  the  name  of  the  seller  here  on  this  forum  because  it  will  create  problems.  
 
 But  I  suggest  you  reason  out  with  the  guy  thoroughly  and  find  out  why  there  is  delay,  may  be  he  was  too  frustrated  from  customers  calls  therefore  he  may  have  declined  your  call.

 I  do  not  think  that  any  thing  can  be  done  regarding  this,  legally.  This  is  India,  my  friend.  I  know  very  well  you  are  meaning,  but  I  suggest  that  we  do  not  come  up  with  the  name.

 Tirtha  -  Sad  to  hear  this,  Im  not  too  sure  on  the  legal  course  of  action,  but  considering  the  way  our  system  works  i  would  say  its  better  to  just  stay  away  from  it  ....  simple  reason  being  it  will  increase  your  frustration  further.
 
 As  an  example:  I  own  a  Ford  Ikon  which  i  get  serviced  from  a  Ford  Service  Station,  there  i  got  to  know  of  an  incident  where  a  brand  new  car  (1  week  old)  was  damaged  badly  when  it  was  kept  for  service  on  a  test  run,  the  owner  asked  for  a  replacement  car,  the  company  refused  and  said  will  repair  free  of  cost,  the  owner  went  to  the  consumer  court  ......  it  has  been  there  and  still  going  on  for  the  past  3  years  !!!  That  is  the  state  of  our  system.  The  car  by  the  way  is  still  in  the  service  station  rusting  !!!  
 
 As  far  as  this  dealer  is  concerned,  im  sure  disclosing  the  name  here  should  be  a  good  enough  lesson.  But  im  not  too  sure  whether  this  will  be  ok  with  the  Admin.  IMO  it  should  be  ok,  its  all  about  saving  fellow  hobbysists  of  going  through  a  bad  experience.

 Dear  Tirthankar
 Just  wait  for  15  days  and  then  address  this  problem  in  Consumer  Court  near  to  your  home  ie.  Gaziabad..The  court  register  will  ask  you  to  fillup  a  form  and  to  deposite  Rs.  20  /  for  the  court  charges.  Make  sure  all  the  documents  xerox  you  should  keep  in  your  own  file.Within  1  month  they  will  ask  the  party  for  hearing  and  in  3  months  verdict  will  be  given.Just  ensure  the  legal  claiming  setlement   of  the  party's  belongs  to  in  which  state  or  cities  jurisdiction.Anyhow  this  is  not  a  problem  at  all.Im  asking  our  resident  lawyer  about  details  and  will  inform  you  later.  Shocked  Really  a  headache  to  get  goods  in  mailorder.

 The  worst  courier  service  of  India  normally  takes  5  working  days  to  deliver  orders.  We  can't  consider  it  as  delay,  as  even  after  12  days  the  order  is  not  yet  shipped.

 If  he  gets  frustrated  with  Customers  calls,  he  should  not  be  in  Business.  
 
 Dev/Seetha....  I  know  it  will  be  tough  to  get  any  result  in  laws  way  specially  in  India.  But  still  I  want  to  take  a  try.

 Hi  Tirtha,
 
 Sorry  to  hear  your  frustrations/anger  and  disappointment  
 on  not  getting  your  product  on  time.
 
 As  you  have  made  a  purchase  online,  did  you  read  the  disclaimer  and
 shipping  procedure  and  time  taken  before  hand?
 
 Because  12  days  is  very  little  time,  the  basic  time  is  30-40  days  if  mentioned  in  days  or  4-6  weeks  if  mentioned  in  weeks  with  a  disclaimer  of  possible  unintentional  delay.
 
 If  these  were  NOT  checked  before  hand  then,  there  is  no  case  but,
 if  the  seller  made  a  claim  anywhere  that  you  will  receive  your  product  within  a  specified  time  (proof  required  here)  then  your  case  will  be  registered  and  makes  sense.
 
 Hope  you  understand  this.  
 
 Thanks  for  bringing  this  up  and  YES  it  has  happened  to  me  before  but  nothing  could  be  done  here  in  Bangalore.
 
 I  just  waited  on  the  Online  Store  and  they  finally,  they  sent  the  product,  
 but  I  was  a  bit  fortunate  that  they  sent  me  few  perks  too  for  the  delay  from  their  side.
 
 Actually,  in  my  case  my  CC  was  debited  thrice  for  1  purchase  and  the  product  did  not  reach  me  even  after  4  months.  But  eventually  all  got  
 sorted  after  many  many  many  calls  and  email  and  faxes  and  time.
 
 After  that  I  decided  to  look  up  and  read  between  the  lines  before  i  buy  online.
 
 Hope  you  receive  your  product  later  (cant  say  sooner  )  Thumb Up

 No  matter  if  you  choose  to  disclose  the  name  or  not
 If  a  controversy  has  to  be  raked  up  ,  it  WILL  happen  !  Smile
 Remember  a  similar  incident  last  year?
 
 Anyways
 Once,Long  ago,  I  had  to  take  up  a  matter  against  ICICI  ,  I  had  found  out  the  details  of  approaching  a  consumer  court.There  used  to  be  some  organisation  run  by  a  person  who  would  charge  200  rs  as  lifetime  fee  and  he  would  help  you  by  preparing  a  'Strong'  case  against  the  other  party..  I  found  him  through  google  and  had  communicated  with  him  over  email.
 Luckily  the  matter  got  sorted  out  on  its  own  before  it  got  worse.
 
 You  may  have  to  do  the  cost  vs  benefit  analysis  and  decide  if  you  really  want  to  spend  time  to  recover  that  amount.
 As  far  as  teaching  him  a  lesson,  you  can  always  write  reviews  on  websites  like  mouthshut.com  so  that  it  reaches  a  wider  audience.
 Also,
 I  am  sure  there  are  threads  published  on  this  dealers  name  on  IAH.You  can  always  go  and  update  your  experience  there.
 I  think  letting  out  his  name  and  your  experience  is  important  so  that  other  unsuspecting  hobbyists  do  not  fall  into  the  same  trap.

 I  wouldnt  agree  with  the  people  who  are  against  taking  legal  course.  But  you  should  know  what  you  are  getting  into  and  have  to  be  patient.  But  before  that,  write  a  letter  to  the  seller  with  all  the  details  and  send  it  through  a  registered  post  with  acknowledgement.  If  the  seller  receives  it,  wait  for  around  15days  before  going  to  the  consumer  court.  If  he  doesnt  receive  it,  give  a  complaint  at  the  local  police  station  (cyber  cell,  if  its  there)  with  your  bank  account  statement/cc  statement  -  then  it  will  be  a  criminal  offence  on  part  of  the  seller.
 
 By  the  previous  history,  I  can  guess  who  it  might  be  but  I  again  say  that  disclosing  the  name  would  be  a  better  option.  Maybe  you  can  put  it  in  a  blog  if  you  maintain  one.  You  dont  have  to  fear  anyone  as  long  as  you  have  proof  for  what  you  are  telling.

 Please  for  god's  sake  do  not  mock  the  system  of  justice.  
 
 IMO-and  strong  belief-India  is  a  land  of  spiritualism  and  spiritual  people,  before  any  court  gives  justice,  GOD  gives  justice.  But  I  have  had  the  best  of  experiences  from  my  police  and  I  have  faith  in  my  justice  system  also.  Everyone  to  his  own  experience  may  be.....
 
 @T2-  
 
 Please  do  not  do  anything  yet.  First  call  your  CC  provider  and  ask  them  if  payment  can  be  stopped  or  returned.  They  will  guide  you.
 
 Yes  there  is  a  website  for  such  grievances.  But  the  time  is  too  short  for  any  claims.

 Some  people  just  dont  deserve  to  be  kept  anonymous.  I  made  an  online  purchase  in  the  first  week  of  February'2008.  Later  when  I  called  the  owner  i  was  told  that  the  stuff  was  not  available  and  that  they  would  refund  me.  
 I  even  tried  to  follow  it  up  last  week  and  was  told  that  I  will  be  refunded.
 Only  good  thing  is  they  atleast  acknowlege  that  I  had  made  this  order.
 But  the  way  they  treat  you  is  as  if  they  are  doing  a  favour  in  saying  that  they  would  be  refunding...  wish  they  could  refund  it  and  show  as  if  its  a  favour....
 
 Tirtha  ..I  some  how  have  a  feeling  we  are  talking  about  the  same  guy  Sad

 I  have  a  feeling  I  and  everyone  else  knows  who  you  are  talking  about.
 I  ordered  the  same  exact  order  and  got  it  after  two  weeks.
 It  does  usually  come  through  within  that  time,  so  I  wouldn't  get  so  worked  up  about  it.  
 Allow  at  least  two  weeks  for  any  online  shipping  to  happen  in  any  shop.
